WHAT ARE COOKIES

Cookies are small text strings that websites send the user to the device used to access the website, usually to the browser, where they are stored, in order to then being re-transmitted to the same website during the following visit by the same user. While accessing any website, the user can also receive on his device, cookies sent by different websites or web servers (so-called "third parties") on which some elements may reside, such as, images, maps, sounds, specific links to pages of other domains present on the website that the user is accessing to.

Cookies, are usually found in users' browsers in large quantities and sometimes, even with wide temporal persistence characteristics; used for different purposes such as execution of computer authentication, session monitoring, data storage regarding the users who access the server etc.

TYPES OF COOKIES
Cookies are divided into macro-categories: "technical" and "profiling" cookies.

TECHNICAL COOKIES
Technical cookies are those used to the sole purpose of "carrying out the communication transmission over an electronic communications' network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or used to provide this service" (See art. 122, paragraph 1 of the Code)

They are not used for other purposes and are normally installed directly by the website owner or manager. They can be subdivided into navigation or session cookies, they guarantee normal navigation and use of the website (allowing for example to make a purchase or authenticate the access to restricted areas).

The "analytics' cookies" are similar to technical cookies when used directly by the website manager in order to collect data in aggregate form on the number of users and how they visit the website. Functional cookies allow the user to browse according to a series of selected criteria (for example, language, selected products to purchase) in order to improve the provided service.

Another type of cookie is the so-called "Flash Cookie" (Local Shared Objects), used within Adobe Flash Player to deliver some content, such as video clips or animations, in order to remember settings and preferences. Flash cookies are stored onto the device but are managed through a different interface than the one provided by the used browser.

The Adobe website http://www.adobe.com/devnet/security.html provides information regarding how to remove or disable Flash cookies related to a specific domain.

For the installation of these cookies, the prior consent of the users is not required, while the obligation to provide information pursuant to art. 13 of the Code is mandatory, that the website manager, if he uses only such devices, will be able to provide in the manner he deems most suitable.

PROFILING COOKIES

Profiling cookies are designed to create user profiles and are used in order to send advertising messages in line with the preferences expressed by the user while surfing the Internet. Due to the particular invasiveness that such devices may have in the private sphere of users, European and Italian regulations state that users must be adequately informed on the use of the same and thus express their valid consent.

Art. 122 of the Code, where it states "the storage of information in the terminal equipment of a contractor or user or access to information already stored is permitted only on condition that the contractor or user has given his consent after being informed with the simplified procedures referred to in Article 13, paragraph 3" (Article 122, paragraph 1, of the Code).
